1. Definitions
- RationPoint, we, us or our means 360 E-Retails, trading as RationPoint.
- Customer or you means a natural person acting outside their trade, business, craft or profession.
- Agreement means the distance contract concluded between RationPoint and the Customer through RationPoint.nl.
- Product means an item offered for sale through RationPoint.nl.
- Fulfilment partner means the Dutch wholesaler or logistics provider that stores, packs and dispatches Products on our behalf.
2. Applicability
- These Terms apply to every offer made by RationPoint and every Agreement concluded through RationPoint.nl.
- The Terms are made available before you place an order and can be saved or printed.
- If one provision is invalid or unenforceable, the remaining provisions continue to apply. Any invalid provision will be replaced by a valid provision reflecting its purpose as closely as the law permits.
- Mandatory consumer law prevails over any conflicting provision in these Terms.
3. Offers and product information
- We describe Products as accurately as reasonably possible and display their main characteristics, total price including VAT, delivery charges and other mandatory information before purchase.
- For packaged foods, required food information is provided on the product page. The best-before or use-by date may vary by batch and will appear on the delivered Product.
- Product images are illustrative. Manufacturers may update packaging or artwork without changing the Product’s essential characteristics. Always check the delivered label before consuming or using a Product.
- Obvious typographical, technical or pricing errors do not bind us where you knew or reasonably should have understood that an error existed. We will offer you the choice of accepting the corrected offer or receiving a refund.
- Offers remain subject to availability.
4. Ordering and conclusion of the Agreement
- Before submitting your order, you can review and correct the Products, quantities, address and costs.
- By selecting the final payment-obligation button, you submit an order with an obligation to pay.
- We confirm receipt electronically. The Agreement is concluded when we accept your order, normally by sending an order confirmation, subject to payment authorisation and availability.
- We may refuse or cancel an order for a legitimate reason, including suspected fraud, an obvious error, legal restrictions, Product unavailability or an undeliverable address. Any amount already paid for cancelled Products will be refunded.
5. Prices and payment
- Consumer prices include applicable Dutch VAT unless clearly stated otherwise.
- The complete order total and all delivery charges are shown before you place the order.
- Standard shipping costs €4.99 for qualifying orders below €49.99. Qualifying orders of €49.99 or more receive free standard shipping.
- Rice and atta Products are excluded from the standard shipping charge and free-shipping threshold. Their shipping cost is calculated according to shipment weight and shown before payment.
- Discounts, promotions and free-shipping offers apply only under their published conditions and during the stated period.
- Available payment methods are shown at checkout. Payment may be processed securely by Mollie or another payment provider identified during checkout.
- Nothing in these Terms limits mandatory Dutch rules concerning advance payment or available payment arrangements.
6. Fulfilment and delivery
- RationPoint currently delivers only to addresses in the Netherlands, subject to any exclusions shown at checkout.
- Products may be stored, packed and dispatched directly by a Dutch fulfilment partner. RationPoint remains your contractual seller and customer-service contact.
- Orders placed before 17:00 are forwarded for processing as soon as reasonably possible. The cut-off time does not guarantee same-day dispatch.
- The estimated delivery period is displayed at checkout or in the order confirmation. Unless another period is agreed, we will deliver within the maximum period required by law.
- A delivery estimate is not a guaranteed deadline unless we expressly agree otherwise.
- You are responsible for providing a complete and accurate delivery address. We may charge reasonable additional costs caused by incorrect or incomplete information where legally permitted.
- The risk of loss or damage passes to you when you, or a third party designated by you other than the carrier, receives the Products.
- If a parcel is visibly damaged, please photograph the parcel, label and affected Products and contact us promptly. A delay in reporting does not remove your statutory rights.
Further practical information is available on our Shipping, Returns & Refunds page.
7. Availability and substitutions
- If a Product becomes unavailable after ordering, we will notify you without undue delay and refund the affected amount.
- We will not replace a Product with a materially different Product without your consent.
8. Right of withdrawal
- Subject to statutory exceptions, you may withdraw from an online purchase within 14 days after the day on which you, or a third party designated by you other than the carrier, receives the Product.
- Where Products from one order are delivered separately, the withdrawal period starts after receipt of the last Product where the statutory rule provides this.
- You must notify us within the withdrawal period using an unambiguous statement, the model withdrawal form or the electronic withdrawal function provided on RationPoint.nl.
- After notifying us, you must return the Product within 14 days.
- You bear the direct cost of an ordinary withdrawal return unless we agree otherwise or the law requires us to bear it.
- Food is not automatically excluded from withdrawal. Statutory exceptions may apply to Products that deteriorate or expire rapidly and to sealed Products unsuitable for return for health-protection or hygiene reasons after the seal has been broken.
Full instructions, exceptions, the return address and the model form are available on our Shipping, Returns & Refunds page.
9. Refunds following withdrawal
- We refund payments received for the withdrawn Products, including the least expensive standard outbound delivery charge where the complete order is withdrawn and the law requires this.
- Additional delivery costs resulting from your choice of a more expensive delivery method are not refunded.
- We refund without undue delay and no later than 14 days after receiving your withdrawal notice. Where legally permitted, we may withhold the refund until we receive the Products or you provide evidence of return, whichever occurs first.
- Our operational target is to process an approved refund within 5–7 business days. Bank processing may take additional time. This target does not extend any statutory deadline.
- We use the original payment method unless you expressly agree otherwise and do not charge a refund fee.
- You are responsible only for diminished value caused by handling beyond what is necessary to establish a Product’s nature, characteristics and functioning.
10. Conformity and legal guarantee
- Products must conform to the Agreement and possess the qualities you may reasonably expect.
- The statutory legal guarantee applies and is not limited by any manufacturer’s or commercial warranty.
- If a Product is incorrect, damaged, unsafe, expired on delivery or otherwise non-conforming, email care@rationpoint.nl with your order number and relevant photographs where reasonably possible.
- Depending on the circumstances and applicable law, we will provide an appropriate remedy such as replacement, repair, price reduction or refund. We bear the necessary return cost for a justified non-conformity claim.
11. Food safety, allergens and recalls
- Always read the delivered Product label before consumption or use, particularly if allergies, intolerances, medical conditions or dietary restrictions apply.
- Manufacturers may change formulations and packaging. Contact us before ordering if required information is unclear or appears incomplete.
- Product descriptions and general content on RationPoint.nl do not constitute medical advice.
- Do not consume or use a Product that is damaged, incorrectly sealed, recalled or otherwise appears unsafe.
- If a safety issue or recall arises, we may contact affected Customers using their order details and share necessary information with the responsible supplier or competent authority.
12. Complaints
- Send complaints to care@rationpoint.nl. Include your order number, a clear description and supporting evidence where reasonably relevant.
- We aim to acknowledge complaints within 2–3 business days and provide a substantive response within a reasonable period.
- Please give us a reasonable opportunity to investigate and resolve the complaint.
- You may also use a competent statutory or recognised alternative dispute-resolution procedure available under Dutch law where applicable.
13. Customer accounts
- You are responsible for keeping account credentials confidential and promptly reporting suspected unauthorised use.
- Account information must be accurate and current.
- We may suspend or close an account for misuse, fraud, security risks or serious breach, without affecting existing statutory rights and obligations.
14. Product reviews
- Reviews must reflect genuine experiences and may not contain unlawful, misleading, abusive or irrelevant content.
- We do not describe a review as a verified purchase unless reasonable verification measures have been applied.
- We may moderate reviews on objective grounds, but do not remove genuine negative reviews merely because they are unfavourable.
- Any incentive provided for a review will be disclosed.
15. Liability
- RationPoint is liable as required by mandatory law.
- Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for intent or deliberate recklessness, unsafe Products, death or personal injury where applicable, or breach of mandatory consumer rights.
- To the extent permitted by law, we are not responsible for damage caused by improper storage, use contrary to the label, disregard of allergen or safety warnings, or unauthorised alteration after delivery.
16. Privacy
We process personal data as described in our Privacy Policy and Cookie Policy.
17. Changes to these Terms
- The version accepted when you place an order applies to that Agreement.
- We may update these Terms for future orders. A change will not retroactively reduce your rights under an existing Agreement.
18. Governing law and disputes
- Dutch law applies, without depriving a consumer of mandatory protection under any law that cannot contractually be excluded.
- Disputes may be submitted to the competent Dutch court, subject to mandatory consumer-jurisdiction rules.
